📋 Terms of Use

1. Acceptance of Terms

By accessing or using the Perkfinity website (www.perkfinity.net), the Perkfinity mobile application (iOS and Android), or any related services (collectively, the "Services"), you agree to be bound by these Terms of Use. If you do not agree with these terms, please do not use our Services.

2. Description of Services

Perkfinity is a digital perks and rewards platform that connects local businesses ("Merchants") with consumers ("Members") through:

  • For Members: A mobile app to discover, claim, activate, and redeem digital perks and rewards at participating local businesses via QR code scanning.
  • For Merchants: A web-based dashboard to create and manage digital campaigns, perks, and announcements, manage member engagement, and track perk redemptions.

3. Account Registration

A. Member Accounts

  • You may create an account using email/password, Apple Sign-In, or Google Sign-In.
  • You must provide accurate and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must be at least 13 years of age (or 16 in certain jurisdictions) to create an account.

B. Merchant Accounts

  • You must be authorized to represent the business you are registering.
  • You must provide accurate business information including name, address, and contact details.
  • You are responsible for all activity that occurs under your merchant account.
  • Perkfinity reserves the right to verify business information and suspend accounts that provide false or misleading information.

4. Member Terms

A. Using Perks and Rewards

  • Perks are digital offers provided by participating Merchants and are subject to each Merchant's terms and conditions.
  • Perks must be activated in-store by scanning the Merchant's Perkfinity QR code.
  • Activated perks have a time limit for redemption. If not redeemed within the allotted time, the perk expires and returns to your available perks.
  • Each perk may only be redeemed once per issuance.
  • Perkfinity is not responsible for the quality, safety, or fulfillment of products or services offered by Merchants.

B. Communications

  • By creating an account, you agree to receive transactional emails (account verification, password resets).
  • You may receive campaign emails from Merchants about their offers. These emails are sent by Perkfinity on behalf of the Merchant — your email is never shared directly with the Merchant.
  • You may opt out of campaign emails at any time via the unsubscribe link.
  • If you enable push notifications, you may receive alerts about new perks and expiring offers. You can disable these in your device settings.

5. Merchant Terms

A. Campaigns and Perks

  • You are solely responsible for the accuracy and legality of the perks, offers, and announcements you create.
  • You must honor active perks presented by Members through the Perkfinity app.
  • You may not create misleading, fraudulent, or deceptive offers.
  • Campaign emails are sent by Perkfinity's email service on your behalf to qualifying members.

B. Subscription and Billing

  • Perkfinity offers a free trial tier and paid subscription tiers with varying features and limits.
  • Free trial accounts may be converted to paid subscriptions based on usage thresholds (e.g., number of members).
  • Paid subscriptions are billed monthly. Payment is due at the start of each billing cycle.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • Perkfinity reserves the right to modify subscription pricing with 30 days' advance notice.

C. Member Privacy

  • You acknowledge that you do not receive Members' personal contact information (email, phone) through the Perkfinity platform.
  • You receive only aggregated, anonymized data about perk usage and member engagement.
  • You may not attempt to identify, contact, or solicit individual Members outside of the Perkfinity platform.

6. Prohibited Conduct

You agree not to:

  • Use the Services for any illegal, harmful, or unauthorized purpose.
  • Attempt to gain unauthorized access to accounts, systems, or data.
  • Impersonate another person or entity.
  • Use automated tools, bots, or scripts to access or interact with the Services without permission.
  • Create multiple accounts to abuse perks or rewards.
  • Interfere with the proper functioning of the Services.
  • Reverse engineer, decompile, or disassemble any part of the Services.
  • Upload or transmit viruses, malware, or other harmful content.

7. Intellectual Property

  • The Perkfinity name, logo, and all related branding, content, and technology are the property of Perkfinity.
  • You may not use our trademarks, logos, or branding without prior written consent.
  • Merchants retain ownership of their business logos and content uploaded to the platform.

8. Disclaimers

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

  • Perkfinity does not guarantee the availability, accuracy, or reliability of the Services.
  • Perkfinity is not a party to any transaction between Members and Merchants.
  • Perkfinity does not guarantee the quality, safety, legality, or availability of any products or services offered by Merchants.
  • Perkfinity is not responsible for any disputes between Members and Merchants.

9. Limitation of Liability

To the maximum extent permitted by law, Perkfinity shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Services.

Perkfinity's total liability for any claim arising from these Terms shall not exceed the amount you have paid to Perkfinity in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold Perkfinity, its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use or misuse of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content or offers you create on the platform (Merchants)

11. Termination

  • You may close your account at any time by contacting us.
  • Perkfinity may suspend or terminate your account if you violate these Terms or engage in prohibited conduct.
  • Upon termination, your right to use the Services ceases immediately.
  • Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes shall be resolved in the courts located in Orange County, California.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page with a new "Last Updated" date. Continued use of the Services after changes constitutes acceptance of the updated terms.
