📋 Terms of Use

1. Acceptance of Terms

By accessing or using the Perkfinity website (www.perkfinity.net), the Perkfinity mobile application (iOS and Android), or any related services (collectively, the "Services"), you agree to be bound by these Terms of Use. If you do not agree with these terms, please do not use our Services.

2. Description of Services

Perkfinity is a digital perks and rewards platform that connects local and online businesses ("Merchants") with consumers ("Members") through:

  • For Members: A mobile app and website to discover, claim, and redeem digital perks — including QR code scanning at physical locations and promo code reveals for online merchants — at participating businesses.
  • For Merchants: A web-based dashboard to create and manage digital campaigns, perks, and announcements, manage member engagement, and track perk redemptions. Merchants participate as one of four business types: Physical Store, Online Brand, Online + Physical (Hybrid), or Mobile / Pop-Up.

3. Account Registration

A. Member Accounts

  • You may create an account using email/password, Apple Sign-In, or Google Sign-In.
  • You must provide accurate and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must be at least 13 years of age (or 16 in certain jurisdictions) to create an account.

B. Merchant Accounts

  • You must be authorized to represent the business you are registering.
  • You must provide accurate business information. The specific information required depends on your business type: physical address for Physical Store and Hybrid merchants; website URL for Online Brand merchants; operating city and ZIP area for Mobile / Pop-Up merchants.
  • You are responsible for all activity that occurs under your merchant account.
  • Perkfinity reserves the right to verify business information and suspend accounts that provide false or misleading information.
  • Application & Review (Online Brand and Hybrid merchants): Merchants registering as an Online Brand or Online + Physical (Hybrid) business are subject to a review and approval process. Perkfinity typically reviews applications within 1–2 business days. Perkfinity reserves the right to approve or reject any application at its sole discretion. Submitting an application does not guarantee approval or activate billing.

4. Member Terms

A. Using Perks and Rewards

  • Perks are digital offers provided by participating Merchants and are subject to each Merchant's terms and conditions.
  • Physical and Mobile merchants: Perks are activated in-store by scanning the Merchant's Perkfinity QR code. Once activated, a timed redemption window applies. If not redeemed within the allotted time, the perk expires and returns to your available perks.
  • Online Brand and Hybrid merchants: Perks are claimed by revealing a promo code on the Perkfinity platform (app or website). The code can then be entered at the merchant's online checkout or presented in-store. No QR scan or in-store visit is required to claim the code.
  • Each QR-activated perk may only be redeemed once per issuance. For promo code perks, usage limits at the merchant's checkout are subject to the merchant's own platform settings (e.g., Shopify, WooCommerce).
  • Perkfinity is not responsible for the quality, safety, or fulfillment of products or services offered by Merchants.

B. Communications

  • By creating an account, you agree to receive transactional emails (account verification, password resets).
  • You may receive a Daily Digest email from Perkfinity aggregating active deals from multiple participating merchants. This digest is sent by Perkfinity — your email is never shared with individual merchants.
  • You may opt out of Daily Digest emails at any time via the unsubscribe link in any digest email, or by contacting us at hello@perkfinity.net.
  • If you enable push notifications, you may receive alerts about new perks, expiring offers, and location announcements from Mobile / Pop-Up merchants you follow. You can disable these in your device settings.

5. Merchant Terms

A. Campaigns and Perks

  • You are solely responsible for the accuracy and legality of the perks, offers, and announcements you create.
  • You must honor active perks presented by Members through the Perkfinity app or website.
  • You may not create misleading, fraudulent, or deceptive offers.
  • Active campaigns from your store may be included in Perkfinity's Daily Digest email, which is sent to qualifying members by Perkfinity. Individual campaign emails are not sent on behalf of merchants.

B. Subscription and Billing

  • Perkfinity offers a Free Trial tier and a paid Connect subscription to accommodate growing businesses. Enterprise plans are available separately (see below).
  • Physical Store and Mobile / Pop-Up merchants: Free trial accounts are automatically upgraded to a paid Connect subscription when they reach their allocated member limit. By default, the trial allows up to 10 active members. If you signed up using a promotional offer, your limit may be extended to 15 or 20 active members.
  • Online Brand and Hybrid merchants: Billing begins after your application is reviewed and approved by Perkfinity. No charges are made during the application review period. The payment method provided at sign-up will be charged upon approval.
  • Once your specific trial limit is reached (for Physical/Mobile merchants), your account will instantly transition to a monthly paid subscription and the payment method on file will be charged.
  • No Downgrades Allowed: Once your account has been converted to a paid tier, it will permanently remain on a paid subscription. Dropping below your initial member limit — whether by manually removing members or if members delete their accounts — will not downgrade your account back to a free tier or pause recurring billing.
  • Prohibition of Free Trial Abuse: Canceling a merchant account and subsequently registering a new account for the same business entity, location, or ownership in an attempt to circumvent billing thresholds is strictly prohibited. Perkfinity actively monitors for circumvention. Any accounts identified as engaging in this behavior will be automatically transitioned to a paid subscription without prior notice.
  • Paid subscriptions are billed automatically at the start of each billing cycle.
  • You may cancel your subscription at any time via your merchant dashboard. Cancellation takes effect at the end of the current billing period without pro-rated refunds for partial months or unused limits.
  • Enterprise Plans: Businesses with large-scale, multi-location, or custom requirements may contact Perkfinity to discuss an Enterprise plan. Enterprise pricing and terms are agreed upon individually and are not subject to the standard trial or Connect structure. Contact hello@perkfinity.net for details.

C. Member Privacy

  • You acknowledge that you do not receive Members' personal contact information (email, phone) through the Perkfinity platform.
  • You receive only aggregated, anonymized data about perk usage and member engagement — including promo code reveal counts for online campaigns — without any personally identifying information.
  • You may not attempt to identify, contact, or solicit individual Members outside of the Perkfinity platform.

6. Prohibited Conduct

You agree not to:

  • Use the Services for any illegal, harmful, or unauthorized purpose.
  • Attempt to gain unauthorized access to accounts, systems, or data.
  • Impersonate another person or entity.
  • Use automated tools, bots, or scripts to access or interact with the Services without permission.
  • Create multiple accounts to abuse perks or rewards.
  • Interfere with the proper functioning of the Services.
  • Reverse engineer, decompile, or disassemble any part of the Services.
  • Upload or transmit viruses, malware, or other harmful content.
  • Share, publish, or distribute Perkfinity promo codes on third-party coupon sites, social media, or any publicly accessible channel in a manner that allows non-members to use them.
  • Claim or reveal promo codes for merchants you have not legitimately joined as a member on the Perkfinity platform.

7. Intellectual Property

  • The Perkfinity name, logo, and all related branding, content, and technology are the property of Perkfinity.
  • You may not use our trademarks, logos, or branding without prior written consent.
  • Merchants retain ownership of their business logos and content uploaded to the platform.

8. Disclaimers

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

  • Perkfinity does not guarantee the availability, accuracy, or reliability of the Services.
  • Perkfinity is not a party to any transaction between Members and Merchants.
  • Perkfinity does not guarantee the quality, safety, legality, or availability of any products or services offered by Merchants.
  • Perkfinity is not responsible for any disputes between Members and Merchants.

9. Limitation of Liability

To the maximum extent permitted by law, Perkfinity shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Services.

Perkfinity's total liability for any claim arising from these Terms shall not exceed the amount you have paid to Perkfinity in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold Perkfinity, its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use or misuse of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content or offers you create on the platform (Merchants)

11. Termination

  • Members: May permanently terminate their accounts and wipe their PII instantly via the mobile application (Profile → Delete Account).
  • Merchants (Cancellation): May cancel their auto-renewing billing agreements via the merchant dashboard. Upon cancellation, the merchant retains full operational access to the Services until the conclusion of their current, fully-paid subscription cycle. Once the period expires, the merchant enters an automatic 6-month Grace Period where inactive data is retained purely for seamless reactivation.
  • Merchants (Account Deletion): Merchants maintain the right to bypass the aforementioned grace period and permanently wipe their Personal Identifiable Information immediately via the manual deletion tool located within the Billing dashboard. If a merchant initiates a manual Account Deletion prior to the natural expiration of an active subscription period, all rights to access and use the Services shall cease immediately. No prorated refunds or credits will be issued for the remainder of the billing cycle.
  • Involuntary Termination: Perkfinity reserves the right to suspend or terminate your account if you violate these Terms or engage in prohibited conduct. Upon involuntary termination, your right to use the Services ceases immediately.
  • Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification shall survive any form of termination.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes shall be resolved in the courts located in Orange County, California.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page with a new "Last Updated" date. Continued use of the Services after changes constitutes acceptance of the updated terms.
